Terms & Conditions of Entry

1.     Introduction

a.     Information on how to enter and prize details form part of these terms and conditions.

b.     By participating in this competition, the entrant accepts and agrees to be bound by these terms and conditions.

c.     Entries must comply with the terms and conditions to be valid.

2.     Privacy

a.     The Promoter will collect and use each entrant’s personal information for the purposes of:

                                               i.     Conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition);

                                             ii.     Building a subscriber list for the purposes of emailing newsletters and relevant promotional messages associated with the Promoter.

b.     By entering the Competition, entrants consent to the use of their personal information as described in clause 2.a.

3.     Who Can Enter the Competition

a.     This competition is open to residents of Australia only.

b.     Only one entry per person is permitted.

c.     Directors and employees (and their immediate families) of the Promoter are ineligible to enter.

4.     How to Enter the Competition

a.     To enter, each entrant must complete the online entry form that is the basis for this Competition.

b.     The Promoter reserves the right, at any time, to request verification of the identity, residential address and any other information relevant to any entrant in the Competition.

c.     The Promoter reserves the right, at its sole discretion, to refuse to accept entries that are incomplete or do not comply with these terms and conditions, or which may contravene any applicable laws or regulations.

d.     The Promoter reserves the right, at its sole discretion, to disqualify any entrant who has breached these terms and conditions, has engaged in unlawful or improper conduct or acts to cheat, tamper with or undermine this Competition to attempt to gain a competitive advantage over other entrants.

e.     The eligibility of any entry is solely at the discretion of the Promoter.

f.      The Promoter is not responsible for any entries that are late, lost, incomplete, damaged or otherwise inadmissible.

5.     Prizes

a.     Each Prize is non-transferable, exchangeable or redeemable for cash.

b.     If a Prize or any part thereof is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute a prize with equal or greater monetary value.

c.     Once the prize has left the Promoter’s premises, the Promoter takes no responsibility for the loss, damage or theft of the Prize.

d.     A winner’s use of the Prize is entirely at their own risk. The winner agrees to indemnify the Promoter against any liability arising from the acceptance and/or use of the Prize.

6.     How the Winner/s are Determined

a.     The competition is a game of chance.

b.     Each valid entry will be entered into a process of random selection.

c.     The same number of winners as prizes will be drawn.

d.     The prize draw will take place on the date specified in the information about how to enter.

e.     The Promoter’s decision is final and no correspondence will be entered into.

7.     Notification and Claiming the Prize/s

a.     The Promoter will contact each winner via the email provided on their entry form.

b.     The Promoter will advise each winner of the method for claiming their prize. This may be via post, or in person.

c.     It is the responsibility of the winner to provide correct delivery details.

d.     All travel to, from and within the Jervis Bay region is the responsibility of the winner.

8.     Unclaimed Prizes

a.     The Promoter will take all reasonable steps to notify the winner/s and deliver the prize/s, however, if a prize remains unclaimed or a winner cannot be identified or contacted within two weeks of the prize draw, the Promoter will draw a new winner.

b.     Any new winner will be contacted in accordance with these terms and conditions.

9.     No Liability

a.     Any prize provided by a third party is subject to the terms and conditions of that third party supplier. The Promoter shall not be responsible for any loss or damage whatsoever, including damage to property, personal injury or death sustained in connection with any prize that forms part of this competition.

b.     The winner/s and the third party suppliers retain their rights under Australian Consumer Law.

10.  Termination of Competition

a.     The Promoter reserves the right to vary these terms or cancel the competition at any time without liability to any person, subject the relevant laws.
